REFERENCES
FMCSA amends the Federal Motor Carrier Safety Regulations to establish requirements for the Commercial Driver’s License Drug and Alcohol Clearinghouse (Clearinghouse), a database under the Agency’s administration that will contain information about violations of FMCSA’s drug and alcohol testing program for the holders of commercial driver’s licenses (CDLs).
The Clearinghouse contains the following information on all CDL driver drug and alcohol program violations.

Report for duty/remain on duty for safety-sensitive function with alcohol concentration of 0.04 or greater or while using any drug specified in the regulations (Part 40), other than those prescribed by a licensed medical practitioner

Alcohol use while performing, or within four hours of performing, a safety-sensitive function.

Test positive for use of specified drugs

Alcohol use within eight hours of an accident or until the post-accident test is completed, whichever occurs first

Refusing to submit to a required alcohol or drug test All CDL drivers who operate CMVs on public roads, and their employers and service agents.
VIOLATIONS ARE REPORTED TO THE CLEARINGHOUSE BY THE MEDICAL REVIEW OFFICER OR EMPLOYER.
